1. Service

1.1 The following Terms and Conditions for the product “CutToPlan” from DigiF9 Ltd, herein referred to as “DigiF9”, is a legal contract between you, the user, and DigiF9. By clicking “Accept” or continuing to use this site and service, you agree to the terms and conditions of this agreement.

1.2 DigiF9 is entitled to change or update these terms and conditions at any time. The user will be notified via email of these changes. Any use of the service after the user has been notified will be taken to mean that the amendments have been agreed to. In the event that the user does not agree to the terms and conditions, DigiF9 are entitled to terminate the account of the user without notice.

1.3 DigiF9 are entitled to make changes to and update the service at any time. Any updates or changes will be made after the user has been notified via email, if the change is service impacting.

2. Registration, Accounts and Security

2.1 To use this service, an account must be created. By agreeing to these terms and conditions, you agree that any information provided during the user registration process is correct, complete, and up to date.

2.2 The user account may only be used by the registered user, and they must not share their password with anyone.

2.3 All fees are payable in accordance with the agreed payment terms at the time the fee becomes payable. DigiF9 is entitled to modify its pricing at any time. Any dispute involving payment can lead to immediate termination of service. All fees and charges are non-refundable.

2.4 The agreement is automatically extended unless the user has cancelled the subscription.

2.5 Upon completion of any free trial, the account will be terminated unless the user purchases a paid plan. Unless the user is on an auto-enrol scheme, in which case the paid subscription will commence the following day.

2.6 The user may cancel their subscription with 30 calendar days’ notice in writing.

2.7 At the end of the contract period, 1 month for monthly paying users and 1 year for yearly paying users, DigiF9 has the right to terminate any contractual relations with 30 calendar days’ notice, without providing any reason.

2.8 Payment will be due on the 1st or 15th of each month for a monthly contract. Yearly contracted users will also be due to pay on 1st or 15th of the contracted month.

2.9 The user is responsible for all actions carried out on their account, including the confidentiality of any personal data, any intellectual property or anything else stored on that account. You hereby agree to notify DigiF9 of any unauthorised access on your account as soon as you become aware of this activity. Failure to do so can result in termination of the account.

2.10 The user may not use the service for any unlawful or unusual activity as determined by DigiF9 in its discretion.

2.11 The user may not attempt to gain information from the service other than that which they have permission to access. This includes, email addresses, phone numbers or any other information to which they have no permission to access or use.

3. Conditions

3.1 The software must only be called or used via the website cuttoplan.com by the user. Automation withoutwritten permission from DigiF9, is forbidden.

3.2 The user is solely responsible for violations of any laws or regulations and must not infringe upon these laws and regulations. This includes but is not limited to, any breaches of copyright, trademark, competition law, etc.

3.3 The user will bear the cost of any legal proceedings that arise as a result of actions by the user and/or carried out via the user’s account.

3.4 The user must not use the service to store or distribute any content that is deemed illegal, suspicious, or malicious. This includes but is not limited to, content that is damaging, racist, abusive, defamatory, pornographic or any software that can be used maliciously.

3.3 DigiF9 retain the right to remove/delete any content that violates these terms and conditions. DigiF9 also reserve the right to disable or delete accounts that violate these terms.

3.4 Any content uploaded to or added to the site will remain the property of the user.

3.5 DigiF9 can use/modify/delete any materialthat is required to fulfil the service offering or for legal purposes.

3.6 The User is obliged to make copies of their own data. In the event an account is terminated or has any failures, data may be deleted and could be unretrievable.

3.7 The user may not download any part of the software or its code. Whether this is for the software to be used offline, on another service,and/or the code to be published on a public or private space.

3.8 Any issues or bugs found in the service, must be reported to DigiF9in writing within 24 hours.

3.9 The user is not permitted to modify any documentation or property of DigiF9.

4. Liability

4.1 CutToPlan is provided by DigiF9 “as is” and “as available” without any warranties, either express or implied, including but not limited to, the implied warranties of fitness for purpose, or warranty of non-infringement.

4.2 DigiF9 makes no warranties about the software’s completeness, accuracy, reliability, availability, or sustainability.

4.3 DigiF9 will not be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this service.

4.4 Every effort is made to keep the service up and running smoothly. However, DigiF9 takes no responsibility for, and will not be liable for, the service being unavailable due to technical issues.

4.5 The user acknowledges that any material downloaded from the website or the service is done at the user’s own risk. DigiF9 will not be liable for any damage to the user’s device or loss of data as a result of this activity.
